    • Tate's first wife was Carrie Mutz. She died before his marriage to Lucretia Harney Hardwick.

      In his application for enrollment into the Chickasaw tribe through his marriage with Crecy Hardwick, Tate stated that he had been a resident of the Chickasaw nation for 30 years prior to his marriage to Crecy. They had married in 1893 in Cliff. He was a continuous resident of the Chickasaw nation except for a five year period, from 1897 to 1901, during which time he was in prison in Sherman, Texas. He indicated that he "had been at Paris several times as a witness, that is when I was arrested."

      His arrest may have related to the following charges as referenced in the Ft. Smith Criminal Case Files, 1866-1900, : "Tate MERRIMAN, a white man, who did, in the Indian Country, Western District of Arkansas, on or about the fifteenth day of January 1886 feloniously steal, take and carry away from the lawful possession of David HARDWICK Nine head of Hogs of the value of forty five dollars against the peace and dignity of the United States. Witnesses were David HARDWICK, Wm. DAVENPORT, One Joe and One Other. He was arrested on the 26?sup?th?/sup? day of April at Woodville, Chickasaw Nation. Tate MERRIMAN posted his bond, with Ben T. DUVAL and Richard T. KERR as sureties on the Tenth Day of May 1886 at the U.S. Court Room at Fort Smith."
