    William Marshall was married twice, having five children by his first wife and seven by his second wife.     The land records for William begin in 1805, when he purchased 137 acres on waters of Little Otter River. He and Sarah sold half of this land in 1815. Then they purchased 286 3/4 acres on Reed and Wolf Creeks in 1819. After William died the commissioner of his estate sold 271 1/2 acres in 1841 described as on headwaters of Reed Creek, a north branch of Goose Creek. (Ralph Marshall, p 17).

    The 1810 census (in which he is listed as William Marsh) indicates he had 4 sons and 1 daughter, but no wife at that time. (Ralph Marshall, p 22).

    Ralph Marshall cites Harry Fulwiler's book GATEWAY TO THE SOUTHWEST which includes a brief biography of the Marshall family on pages 739-740: "William Marshall was born in Maryland, a soldier of the War of 1812 in Captain John P. Gray's Bedford County Company of the Bedford Regiment, assigned to regiment at Camp Bottom's Bridge. He married Sarah Pollard (1795-1864), a daughter of Thomas and Keziah Hunt Pollard of Bedford County, Va. They had at least eleven children. Eight sons and three daughters are named in the administration of his estate in Bedford County Will Book 12, page 460. At the time of his death in 1839, he owned 69 1/4 acres and eleven slaves. One man, Sam and his wife Ann, and child Elizabeth were valued at $550; one man, Anderson, value $600; one boy Jacob $50; one girl Harriet $450; one girl Matilda $225; one girl Charlotte $375; one girl Carolina $270; one boy Jim $231, and one girl Martha $150. He had a "water grist" and saw mill on the waters of Reed Creek. The Marshalls were diligent in their care of their slaves, always sure they were well cared for in sickness and in health. They did their best for them and good feelings and kindnesses were mutual. This was evidenced by the fact that after freedom was given them, they stayed on with future generations."     Ralph Marshall further noted that the estate inventory and appraisal are recorded in Will Book 10, page 132. The division of the estate in 1845 did not include the name of daughter Cassondra who married Goodrich Moore in 1833 and was living next door to other family members in the 1850 census. There is nothing to indicate an intentional omission of her name from the list of heirs.

    Notes:

    Alexander Marshall, son of the foregoing (Thomas Marshall, a native of Wales) and father of the subject (Junius S. Marshall), was born in Maryland, March 24, 1790. He went with his parents to Virginia when quite young, remaining in that state until about the 1818, at which time he immigrated to Kentucky and located in Hardinsburg, where he engaged in the shoe-making and grocery business. After a few years spent in the town he moved about one mile and a half south to the place where subject (Junius) now lives, on which farm he located, and on which his death occurred January 6, 1867. (Ralph Marshall copied this from an article discovered in the summer of 1980 in the Kansas City, Missouri Public Library from the "History of Kentucky, Illustrated 1887 pps. 1072-1073).

    Ralph Marshall writes that eight deeds are recorded for Alexander Marshall between 1816 and 1829. All mention either Goose Creek, Dick's Branch or Amos Branch, a tributary of Goose Creek. Alexander made application in 1819 to erect a saw mill on Amos Branch but the only land purchase shown prior to that year was 30 acres on waters of Goose Creek in 1816. Alexander and Elizabeth purchased 80 acres on Amos Branch in 1821, the year they apparently moved to Breckinridge county, Kentucky, and then sold it for $250 to Thomas Wade in 1829.

    At the time of the 1830 Federal Census for Kentucky, the household of Alexander Marshall is listed as follows:

    Two males under age 5, one male between the age of 5-10, one male between the age of 10 and 15, and one male between the age of 40 and 50, one female under age 5, 3 females between the ages of 5-10, one female between the age of 10-15, and one female between the age of 30 and 40.

    Alexander married Elizabeth "Betsy" Hix on 21 Dec 1810 in Bedford County, Virginia.     Ralph notes that Alexander Marshall was surety for (the marriage) for his sister, Wilmoth. (Ralph Marshall, p 16).

    Wilmouth (Willey) married Caleb Ferguson (also spelled Fergerson) in September 1809. Census shows 5 sons and 5 daughters were born to this union by 1830. Bedford county marriage records show 4 Ferguson boys (marrying) from 1839 to 1850, but don't know how many of them belonged to Caleb and Wilmouth as there were other Ferguson families in the county.     The 1850 census shows her as age 56 and born in Virginia which would place her between Alexander and Samuel. Was most likely the first child born in Bedford county after the move from Maryland.

    Notes:

    During a November 2002 research trip to Missouri and Kentucky, Charles Strong found in the Breckinridge County archives a booklet titled "Descendants of Thomas Marshall Bedford Co., Va. Plus Hix-Owen-Nicholson & Related Families" compiled by Ralph E. Marshall. Completed September, 1986" Charles copied numerous relevant pages from this booklet, the copies now in the files of Melinda McLemore Strong in San Antonio. This book states that Samuel Marshall was the next to youngest son of Thomas Marshall. It was speculated by the author that "Perhaps Samuel had demonstrated good business sense or was a favorite of his parents as Thomas appointed him the Executor of his Will in October 1819. William and Alexander were several years older than Samuel and lived in the same part the county but were not chosen for that responsibility. Samuel and Alexander must have been fairly close as brothers as they married the Hix sisters and then took their families to Breckinridge county, Kentucky.

    Census and birth records indicated that the Samuel and Alexander Marshall families made the move to Kentucky after the 1820 census was taken but probably not later than the spring of 1821. Alexander is recorded as a grocer and shoemaker in his earliest years in Hardinsburg but there is less information on Samuel. The first record of a land transaction for Samuel shows him purschasing 141 1/4 acres of land for $330 from Littleton and Lucretia Martin of February 23, 1825. This farm was about 1 1/2 miles south of Hardinsburg and bordered on land purchased by Alexander in 1829. The 1830 census (below) lists Samuel and Alexander as neighbors and Samuel is shown with one slave. Charles made a xerox of the actual deed, which was in Book G, pages 143 and 144.

    They are recorded there in the 1830 census [KY Microfilm No. 16, page 65]. The only other Marshall head of household is his brother, Alexander Marshall.

    Samuel Marshall's listing on the 1830 census shows his household consists of one (1) free white male from between the ages of 5-10, and one (1) free white male between the ages of 30 and 40. There are also two (2) free white females under the age of 5, two (2) free white females between the ages of 5-10, and one (1) free white female between the age of 30 and 40.

    Fourteen years later, in 1835, they migrated again, this time joining the great four year rush caused by the opening to pioneer settlement of the last Missouri Indian Lands. This great human movement, which ended in 1837, was not unlike the Californian gold rush of later years. This time the Marshalls settled in rural Lewis Co. from where they then moved to LaGrange at a later date, possibly in the 1870s.

    A visit to the courthouse at Monticello in Lewis county revealed that Samuel was involved in many land transactions from 1835 to 1870. History books lists him as a settler in 1835 in Union Township 60, Range 6, so he probably farmed just west and perhaps a little south of LaGrange. (Ralph Marshall, p 27).

    Census lists him as a retired farmer living in LaGrange with real estate valued at $5,000 in 1860 and $4,000 in 1870. Town of LaGrange currently has about 1,200 population and is located on the Mississippi River in southeast part of Lewis county. No examination has been made of all the recorded land transactions but Samuel and Hannah did sign a deed on March 23, 1867. Then the next record in July 1869 was for sale of land by another person acting as trustee for Samuel, an indication that he was no longer capable of handling his own affairs. Perhaps the last entry was in December 1870 where there was a Sheriff's sale of some lots Samuel owned in LaGrange. No will or probate is on record at the Monticello courthouse so perhaps there was little property left to be disposed of when Samuel and Hannah died. At this point, no cemetery record has been found to indicate when Samuel and Hannah died or where they are buried. It would seem logical that they were either buried in LaGrange or at Asbury Chapel where their son Winfield was laid to rest in 1871. The author walked over the LaGrange cemetery in June 1985 and found not Marshall stones but there were also areas where the markers were broken or had disappeared. (Ralph Marshall, p 27).

    The following obituary was found by Mary Pat Strong and Charles R. Strong on an earlier research trip, in June 2002, at the LaGrange Public Library.

    DIED

    MARSHALL-In this city on the morning of the 4th inst. Samuel Marshall, in the 85th year of his age.

    Mr. Marshall was one of the pioneers in this section, being one of the oldest men in the county. He has long been an invalid and his death was no surprise to his friends. A funeral discourse was preached at the residence of the deceased by Eld. Jas. Penn, Tuesday morning, after which the remains were followed to the city cemetery by weeping relatives and friends.

    Notes:

    Riley is not one of the children who were specifically listed in the Will of his father, Thomas Marshall, or in any other Bedford County records. However, his relationship is well established by the testimony of his youngest son, Woodson.

    Marilyn Childs sent Tom Marshall a copy of the account from Woodson's notebook, now in the hands of her aunt Jane Beard. His record says:

    "It is traditional in our family that before the Revolutionary War, three brothers: John, Samuel and Thomas Marshall came from England and settled in the Colonies. The two former in Maryland, the latter in Virginia.

    Thomas Marshall lived near Liberty in Bedford county, Virginia where my father Riley Marshall was born Sept. 15, 1797. His mother's maiden name was Oliver, and she belonged to a family of much respectability and for whom my oldest sister Harriet Oliver was named.

    My father disliked slavery and on reaching his majority, emigrated to the new free state of Ohio. One of his brothers, Alexander moved to Kentucky and one, Samuel to Missouri. His only (sic) son, Silas N. Marshall, lived in Little Rock, Arkansas."

    Some authorities claim that the father of Riley was Capt. Thomas Marshall, a brother of Chief Justice John Marshall. However, that Thomas married Frances Kennan and went to Mason County, Kentucky by 1790.

    The slavery issue, mentioned by Woodson above, may have sparked some family disagreements and may have been at least a partial factor in the decision of Riley and the Van Pelt's to go to Ohio in 1817 and Alexander and Samuel to Kentucky in 1820. Kentucky was not a free state but census records never show Alexander with any slaves and Samuel with just one colored female under age 25 in 1830.

The Stinnett's appear in the 1840 census but moved on to Texas in the mid-1840's where he had the first grist mill in the state. A grandson founded the town of Stinnett, Texas. Joel was the son of LINDSEY & NANCY (MARSHALL) STINNETT in Bedford County, Virginia. Nancy was an older sister of Samuel Marshall. (Ralph Marshall, p 30).

    Excerpt of article, transcribed by Ralph Marshall, about Junius Marshall:

    To Alexander and Elizabeth Marshall were born twelve children, only four of whom are now living: Edwin, Jane, Emily and Junius S. The last named was born in Breckinridge County April 18, 1834. He was educated in the common schools of the country, which he attended at intervals until his twenty-first year, but by far the greater part of his education has been obtained in later life, as he has always been a ready and practical observer. He took charge of the home place after reaching his majority, looking after his parents' interests in the meantime, and in 1862 purchased the farm of his father, and since resided upon the same. Mr. Marshall's home, which is one of the best in the vicinity of Hardinsburg, consists of 350 acres of good land, one mile and a half south of town, on the Hartford road, and is well improved and under succesful cultivation. Mr. Marshall has been a very successful farmer, and is in every respect a true type of the quiet, law abiding, country gentleman. He married, July 22, 1863, Artemissa, daughter of Robert and Nancy (Scott) Payne. Mrs. Marshall was born in Breckinridge County on December 18, 1844. Mr. and Mrs. Marshall are the parents of the following children: Nannie, Lizzie, Lucy (deceased), Thomas E., Emily F. (deceased), Willie, Samuel, Humphrey, Robert A., Mary, and Idah. Mr. Marshall is a Democrat in politics; belongs to the Masonic fraternity, and is an active member of the Methodist Church. He and his wife belong to the Oakland congregation. Ralph Marshall copied this from an article discovered in the summer of 1980 in the Kansas City, Missouri Public Library from the "History of Kentucky, Illustrated 1887 pps. 1072-1073."

    Ken Harvey cites Lewis County, Missouri Marriage Book 1, Page 77, and shows that Cinderella was married on 15 Aug 1839 to Frederick Keenaash (1815-1845), and shows their children as Mary (1840-1847), Lavinia (1842-1845), and Catherine (1845-1847).

    He also indicates that her husband and three children died in the space of two years and seven months. She returned home to live with her parents. She lived with her parents in the 1850 (H/Cinderilia KENOSH) 1860 (Cinderella F. Marshall) and 1870 census (Cardwell (sic) KEENOSH). She died at the age of 57 years and eleven months.

Somewhere around 1868 Winfield moved farther west in Lewis County to Salem Township with a LaBelle address. He was buried in the Asbury Chapel Cemetery (Ralph Marshall, p 28).

    In THE PAYNES OF VIRGINIA by Brooke Payne, it is noted that she is the daughter of "Silas Marshall of Lagrange, Mo." This is not correct, Silas is actually her brother.

    Following marriage in about 1844, the young couple were living next door to Martha's parents in Lewis Co., Missouri.

    Fay Payne Yeager found the family on the 1850 census is Lewis County, Missouri.

    Dorothy (known as Dotty Bob) Thompson has a Marshall family bible that may have information in it.

    Her tombstone in Marlow Cemetery gives her date of birth as 27 Mar 1827; that is exactly one year after what family records show as her her actual birthdate. It is possible that the tombstone is incorrect.

    She was 74 at the time of her death, and had been living with her youngest son, Walter and his wife Gertrude at the time of the 1900 census, taken a few months prior to her death.

    Martha married Thomas Hamilton Payne on 5 Aug 1843 in Clark County, Missouri. Thomas (son of William C.     Notes:

    Shown in 1850 as a 19 year old store clerk in LaGrange. In 1860, Silas was listed as a merchant with real estate of $2,300 and personal property of $10,000. Deed records at Monticello, Missouri show that Silas disposed of his LaGrange interests in October 1870 and May 1871. The final transaction may have been executed during a visit to Lewis county prompted by the death of his brother Winfield in March of 1871. (Ralph Marshall, p 29).

    In 1880 and 1900 he can be found in Pulaski County, Arkansas with his family. His occupation was shown as insurance agent on both census enumerations.

    He can not be located on the 1910 Census. His sister, Caladonia, who had lived with the family at the time of the prior two census enumerations had moved to Oklahoma, and was living with her niece, Sarah Elizabeth Payne O'Neill. Presumably Silas had moved to California, as the March, 1913 obituary for his sister Caladonia states "the death of a brother in California the week previous caused a nervous shock which hastened the ravages of [her] disease." Her only other brother, Winfield, had died in 1871.

    Miss Callie Marshall Dead, Cousin to Vice-President

    Miss Callie Marshall, aged 77 years, died at the home of Mr. John O'Neill in this city Sunday morning and the remains were shipped to LaGrange, Mo., for interment. She had been in fairly good health, but the death of a brother in California the week previous caused a nervous shock which hastened the ravages of disease.

    Miss Marshall had been a resident of Duncan some time. She was an aunt of Mrs. O'Neill and an own cousin to Vice-President Marshall, besides being well connected in other respects. Though known to only a few people in Duncan, she had their esteem and love and her death came as a severe blow. The Banner joins in the universal expressions of sympathy in the death of this good woman.

    Quincy, Ill., March 5.--At almost the same time that Vice President Thomas R. Marshall was inaugurated Tuesday, funeral services were conducted for one of his relatives at LaGrange, Mo. ten miles north of here, the boyhood home of Mr. Marshall. It was the funeral of Miss Callie Marshall, 77 years old, a cousin who died at Duncan, Okla. last Saturday.

    NOTE: Death Certificate #2553 said death was due to acute indigestion. Bird O'Neill was informant on death certificate.

    On a transcript of the 1860 Shelby County census, there is a 3 year old Catherine J Pain listed, which means she would have been born ca. 1857. According to the 1880 census, she was age 28, which means she would have been born closer to 1852. This would make her only 10 years younger than her husband, not 15. Is is likely that the 1860 listing for Catherine was actually for younger sister, Caladonia.

    Catherine and her husband, Tom Joyner, are the first of her family to move to Texas. They arrive in Hardeman County in the spring of 1879. In a biography of her brother-in-law, John O'Neill, she was referenced as "Harriett Katherine, who now lived in Idaho...widow of the late Thomas Joiner, a farmer..."

    Obituary of Samuel M. Payne

    Born March 11, 1849 in Marion County, MO. Was married to Miss Olive McClanahan in August, 1873. To this union was born six children, two of whom are dead. His wife died five years ago. About six months ago he was united in marriage to Mrs. Hollingsworth of Duncan, Oklahoma. At this time he is survived by three sons, Marvin Payne of Chickasha, Frank Payne of Wichita Falls, Texas, and Aubrey Payne, Davidson, Okla., and one daughter, Mrs. H.P Haycraft of this city.

    Mr. Payne was not a member of any church or lodge but he was a good man in every respect. He believed in good morals. He strictly believed in the "Golden Rule" "Do unto others as you would be done by." He believed in a supreme being and a higher power and universal salvation. He was a most devoted husband and father.

    He was just a human being subject to the frailities of the flesh. If he made any mistakes we have forgotten them and if he has any accounting to make for the life he lived, he will make it to the Judge of all the earth who doeth all things well and will judge with justice and mercy.

    The following biography of Samuel Marshall Payne was written by Ken Harvey:

    Migrated to Texas on Texan Road (Hwy 69) with his parents and all his brothers and sisters after the Civil War, in abt. 1878. He would have been twenty-nine years old. Initially they all lived in a dugout.

    In appearance he had a red beard and was of slender build. He had a weakness for fast horses which was perhaps encouraged by his contact with the Commanches out west. After all he needed speed to get away from them. He used to stride about the racecourse with tears in his eyes, such was his involvement in racing. He was quite an emotional man.

    He cowboyed for many years in Texas and never considered that he worked for anyone in his life. It was a hard life. He and Ollie once found a man who had been skinned alive by the Indians while going somewhere with a wagon. He never knew if the victim was a whiteman or an Indian. They took him into town but he was dead on arrival.

    On one occasion he found it necessary to hide in a plum thicket from Indians he had inadvertently come across. He stood there holding his horses nose to stop it whinnying. He was very fortunate with the wind direction as the scent of his mount was not carried to the Indian horses. The Indians would either have been in the area horse stealing or on the war path. It didn't really matter as the result for Samuel, if discovered, would probably have been the same.

    1880 - His younger sister, L[ouise] C. Payne (b. 1863), stayed with his young family in Cooke County, Texas. She was "teaching school" at the time in 1880 according to the census.

    1893 - While in living in Texas, Sam came to Oklahoma for the Land Run. He arrived for the opening of the Cherokee Strip in 1893. He came prepared with a wagon and team in order to ride with a lightweight racing saddle on his accompanying thoroughbred horse. He wore light boots and a cap with the bill turned backwards. He said he didn't want to look like a cowboy-he just wanted maximum speed. He found the land he wanted as he knew the area well from his droving days. He immediately placed his claim. After he got to the land office he sold the 160 acres he was now entitled to. The claim, which never had his name registered, was located near Enid and he was to say he made more money in that single transaction than he could have done in one whole year of being a cowboy.

    In 1893 a Payne family group studio photograph was taken, probably in Quanah. It shows left to right; Samuel Marshall Payne (44) seated, Effie Mae (10) standing, C. Frank (18) seated, Aubrey Hamilton (16) standing rear, Samuel E. (14) standing forground, Marvin Walter (12) standing rear and Olivia McClanahan Payne (49) seated. Sam never grew any more. Lewis Payne has a copy of this photograph and the original is thought to have been with his sister Mary Olive and hence passed on to Dorothy Thompson. Another original is the property of Mary Ann Mounts Payne.

    1895-He was the original entryman to 160 acres in Stephens County; the North-East quarter of section thirty-five in township two, [north of] range eight, west [of the Indian Meridian]. It is located about four miles outside Marlow. Sam and his family settled there, beside Hell Creek.

    1900-The census shows the Sam Payne family living in Hardeman County, Texas.

    1901-Samuel was described by his brother Walter W. Payne as the original entryman to 160 acres in Stephens County, Oklahoma. This land being the north-east quarter of Section thirty-five, township tow [Rock Creek, north of] Range eight (8) west [of the Indian Meridian. This farm was located about four miles outside Marlow]. This grant of land "was established and duly consumated" to Samuel M. Payne on 17 March 1920 by the signature of President Woodrow Wilson in line with the act to secure homesteads on the public domain.

    1910 - Later Samuel purchased a farm about four miles outside Marlow, OK and in 1910 he was listed as living there in Rock Creek Township with his wife Ollie, his married son Marvin, his wife Grace and their child, his grandson, Chadwick. There were also two hired men and a cousin?, Lizzie Pictria (19), in the household. Ollie died in April of 1910 and Samuel became a widower.

    1914-A sepia toned photograph is taken of Samuel in front of his house. The photograph includes (l to r) his son Marvin, Samuel, daughter Effie and her husband Hugh S. Haycraft.

    In an Affidavit of Heirship of Samuel M. Payne who died intestate, Walter W. Payne stated that "...sometime during the year of 1915 he [Samue M. Payne] again married one Leona Hollingsworth." The couple are later listed as possessing one brown mare name Dolly, one sorrel mare names Bell and one whitefaced cow named Mott and her calf. "To this union no children were born and it is my understanding that she [Leona Hollingsworth] has given a deed of conveyance to any interest that she might have had in the estate of my deceased brother."

    1916-Joe Payne of Knoxville records that Samuel died and was buried in Quanah, Texas. This is incorrect. Records from the Marlow Funeral Home instead indicate that he died at his residence in Marlow. His funeral was paid for by his son, Marvin Payne, a few months after the funeral.

    He was buried in the Marlow Cemetery, Section 10, Block 10, Plot 5.

    William H. Payne. One of the strong personal factors in the upbuilding of the town of Marlow, has been William H. Payne, whose career has been closely connected with this section of the old Chickasaw Nation and Oklahoma for a quarter of a century. In the town itself, since it was started, he has shown ample confidence and has invested his capital in enterprises that further the welfare of the place. He was the first president of the Bank of Marlow, and is the principal factor in the recently organized Payne Lumber Company. He has also erected a business house and two dwellings in the town.

    Mr. Payne's career has not been monotonous nor without interesting change from boyhood to the present. Born in Shelby county, Missouri, April 1, 1851, he grew up through boyhood with educational advantages that resulted from the primitive surroundings of that time and locality. After his sixteenth year he began hiring out for farm work, and turned most of his wages over to his parents, as was the old custom. He lived at home until he was about twenty-five, and then, with team and wagon, pioneered his way to Texas, crossing Red river at Delaware Bend and making his first stop at Loren's ranch in Cooke county. He rented some land of Loren and made a corn and cotton crop, but from 1879 on for several years he followed the cattle trail as a cowboy, and in this occupation first went over the ground in the vicinity of the present town of Duncan. After his marriage he located on a farm in Montague county, Texas, and began housekeeping with an extremely limited equipment. From Montague county he moved into the Chickasaw Nation, and at Velma built up his interests both as farmer and stockman. Five years later he brought his home and business to the vicinity of Marlow, where he has since remained. At this writing he still has a lease and runs some five hundred head of cattle, but it is his intention to close this part of his career and continue along quieter lines of activity. With the opening of the Comanche country Mr. Payne got a claim in what is now Tillman county, and while his family lived there to prove it up, he continued his stock business in the Indian Territory, and without neglecting business finally secured a patent to his land. In addition he has purchased some six hundred acres in the same vicinity, and eight or ten tenants are engaged in the improvement and labor of production on his large farm.

    Mr. Payne's personal history connects him with the south. Though he was born in Missouri, his grandfather, William C. Payne, was a native of Loudoun county, Virginia, and had lived a time in Kentucky before moving the family to Missouri. The Paynes were established in Shelby county as early as 1833, and there the grandfather finished his life, passing away in 1865, at seventy-six. His wife was Sarah Hamilton, who also died in Missouri, and their children were: William, who died in Shelby county; Thomas H., father of the Marlow citizen above mentioned; Levi N., who died at Shelbyville, Missouri. Thomas H. Payne, living in a new country and without much assistance from home, gained his schooling in a log cabin and had only a small amount of the world's culture. He became a plain, honest citizen, and a man of worth wherever he lived. During the war he served with the militia in defense of the Union. The last years of his life were spent in Texas, where he died in 1882. He was an active man in the Democratic party. He married Martha Marshall, whose father, Sam M. Marshall, was a Virginian who had first moved to Kentucky and then to Missouri. Martha Payne died at Marlow, Oklahoma, in 1904, having reared a family of ten children, namely: Elizabeth, wife of John O'Neil, of Duncan; Kate, wife of Thomas Joyner, of Oklahoma; Samuel M., of Stephens county; William H., whose career has been sketched; Winfield, near Red Moon, Oklahoma; Levi N., of Wewoka, Oklahoma; Josephine, wife of L. F. McClannahan, of Duncan; Lula, wife of Allison Scott, of Duncan; Thomas B., who died at Duncan, leaving four children; and Walter W., of Duncan.

    William H. Payne married, in 1882, Mrs. Hattie A. Long. Her parents were John B. Brown and Adaline Trowbridge, Vermont people, whose other children were: John B., of California; Irene, wife of H. M. Case; Hiram, who died at Velma, Oklahoma; Hale J., of Los Angeles, California; and Joseph R., of Montrose, Colorado. Mrs. Payne was born at Quincy, Illinois, July 28, 1859, and by her first marriage has a son, Ed. H. Long, of Fort Worth, who married Myrtle Payne and has a son, Willie Virgil. Mr. And Mrs. Payne have two children, Joseph R. and Lee B.

    1910 - Living in Wall Township (Marlow area) of Stephens Co., Oklahoma in 1910. They had a house servant, Pearl Ice (20).

    William H. Payne donated a plot of land for the Marlow cemetery. One section was reserved for the Paynes. This Payne section was not large enough and is now full.

    Charles Strong found the following obituary at the Oklahoma State Archives:

    14 December 1917 DUNCAN BANNER

    "Died

    News of the death of Uncle Bill Payne, which occurred at home in Marlow Tuesday, came as a shock to numerous friends in Duncan. Death came suddenly and unexpectedly, he being in comparatively good health up to the time of his death.

    Mr. Payne was one of the pioneer citizens of this country. He was a man well liked by all, a successful ranchman and business man, and his death has occasioned universal sorrow. He was a brother of W.W. Payne of this city, besides has many other relatives throughout this section.

    Funeral services were held Marlow Wednesday, many friends paying a last mark of respect to deceased."

    An obituary, found by Lynell Gentry Cordell, was also published in the Marlow Review on Thursday, December 13, 1917.

    W.H. Payne Passed Away Monday Even'g

    In the passing of William H. Payne, Marlow loses one of her pioneer citizens, a man of sterling worth and unblemished character. Mr. Payne was identified with the financial and executive interest of Marlow for many years. He was regarded with high esteem by all who knew him, and most by those who knew him best. Large in body, mind and heart, he lived daily the life of clean morals and justice. He was remarkably free from the petty quarrels and smallness that mar so many lives. Born in Shelbyville, Shelby county, Missouri, April 1, 1851, he grew to early manhood in the atmosphere of Kentucky hospitality and courtesy that makes northwest Missouri famous. At the age of 21 years he was identified with the Christian church of that place and never discarded the great moral principle of that faith. In the early days he moved to the country at a time when law and life were matters of little concern. In spite of thse enviroments he lived the hardy life of the pioneers and reared his family and built his home that is a credit to the community and worth of his service.

    After some illness, he passed away on the 10th day of December, 1917, at his home surrounded by his loved ones whos knew him best and realized the full measure of his loss to them. He lived to the ripe age of 66 years, 8 months, and 9 days and was laid to rest in the cemetery at Marlow, Oklahoma.

    His wife and children receive the unstinted sympathy of the entire community in their hour of sorrow, and his presence is missed by all. He died like he lived, free from emnity and bitterness.

    The funeral service was held in his home at 3 p.m. Thursday, Dec. 11, 1917, conducted by Elder E. L. Kirtley and his lifelong friends Dr. P. L. Montgomery, T. L. Rose (?), C. Smyth....(remaining names illegible).

    Notes:

    Ken Harvey notes that "he was recorded on the 1870 Shelby County, Missouri census and shown as age 17, making his year of birth approximately 1853. He went by the name Scott, and was named after the Civil War General Winfield Scott.

    In 1880, he was in Montague, Texas, with his wife and step-children.

    A W. C. Payne was recorded, in Montague County Courthouse Marriage Book B, page 471, as marrying Nora Popejoy on 24 Nov. 1887. This could well be our Winfield Scott Payne. The initial "C." could be an error for "S." This ceremony was conducted by J. F. Shelton, Minister of the Gospel. If this is our Scott Payne, it would have been a second marriage. The 1900 census shows him as the father of two children born between 1876 and 1879. Their names are unknown. Lewis Payne vaguely recalled that Scott's wife was named Lou. Kenneth Harvey shows he remarried circa 1894 to Alice (Unknown), born circa 1852 in Texas.

    Around 1889, the family moved North to Indian Territory. Scott's wife probably died soon therafter (deduced by Ken Harvey based on the 1900 I.T. census)."

    In a biography of his brother, William Henry Harrison Payne, he was referenced as "Winfield, near Red Moon, Oklahoma." In another biography, this one of his brother-in-law, John O'Neill, he was referenced as "Winifred (sic), at Butler, Oklahoma."

    In a biography of his brother-in-law, John O'Neill, he was referenced as "Newton, a farmer near Wewoka, Oklahoma."

    When she was around six year old, ca 1918-1919, Roonie recalls going from her father's ranch to the big Payne farm, over the hill about 1/2 a mile away. When they arrived, Levi Newton Payne and his family were in two covered wagons starting a trip to Arizona. Her parents had gone to the farm to say their goodbyes. She remembered that one of the young children appeared to be retarded/disabled in some way. The family remained in Arizona, which is where Levi Newton died around 1932. (This story was told to Charles Strong by his mother around 1990).

    In the copy of the Will of William H. Payne, he lists Levi as recieving $400. Levi was taught to read by his wife Lizzie, a school teacher. Levi Newton was in the 1889 run and got land near Oklahoma City, but traded it for a horse. (Source: Cova Jean Williams).

    He died from acute angina pectoris on December 3, 1932. The informant was F.L. (Fred Lee) Payne. The undertaker was M.L. Gibbons. he was recorded as 76 years, 4 months and 1 day old. (From his death certificate filed in Arizona). A memorial stone was erected over his grave in 1988.

    Not on Brooke Payne's list of the children of Thomas Hamilton Payne and Martha Jane Marshall. However, in the 1908 biography of her brother, William H.H. Payne, cited the children of Thomas Hamilton Payne as: "Elizabeth, wife of John O'Neil, of Duncan; Kate, wife of Thomas Joyner, of Oklahoma; Samuel M., of Stephens county; William H., whose career has been sketched; Winfield, near Red Moon, Oklahoma; Levi N(ewton), of Wewoka, Oklahoma; JOSEPHINE, wife of L. F. McClannahan, of Duncan." In another biography, this one of brother-in-law John O'Neill, she was referenced as "Gallic (sic), wife of Fred McClannahan, a carpenter and builder who lives at Holbrook, Arizona."

    On the 1860 census, she was listed as "Pain, Catherine J. 3 F Mo" instead of as Caladonia Josephine. In 1870, she was simply listed as Carrie.

    One day Callie commented, after hearing a story told by her grand-nephew Lewis Adair Payne, that she would "have to tell [Vice-President] Marshall about this!" Ken Harvey was not sure if this was a true story, of just Callie being playful with Lewis. It appears, however, that Vice President Thomas Riley Marshall was indeed a second cousin of Caldonia and her siblings.

    Ken also writes that it was understood that three McClanahans (Olivia's siblings) married three Paynes (Samuel's siblings) in this generation.

    Ken thinks her children went to Quanah High School, and that she dies in Quanah. However, as they lived in Oklahoma in 1900, and Arizona in 1910, this may not be correct.

    Caldonia married Lafayette Fred McClanahan on 4 Aug 1878 in Shelby County, Missouri.     1880 - An "L. C. Payne" was recorded living with her married brother, Samuel Marshall Payne, in Cooke Co., Texas on 7 June 1880 where she was listed as [teaching school] at the age of 19.

    In this census reference to L. C. Payne the age is unclear, and could have been 17 years.

    1884 - On her marriage certificate in Montague County Courthouse Marriage Book B, page 183, her name is spelled Lula Payne. The ceremony was conducted by W. E. Wilson, Ordained Minister.

    In biography of her brother William Henry Harrison Payne, she is listed as "Lula, wife of Allison Scott, of Duncan."In another biography, this one of her brother-in-law, John O'Neill, she was referenced as "Lulu, wife of Allison Scott, a retired railroad man at Fort Worth, Texas."

    In his Personal Journal, Lewis Adair Payne wrote on March 21, 1936: "Martha [Scott], Marie [Scott], and Florence [Scott] came back out for an hour or so, I then went with them to Aunt Hatties [Payne nee Brown] to get Aunt Lou [Scott nee Payne]. Then to Duncan. Dinner at Bessies. They home and I to the airport."

    Fay Yeager cites "Indian Pioneer History" volume 40 as saying "Thomas Payne was deputy Marshall of Ardmore 1891-1892." Ardmore is in Carter County, adjoining Stephens County.

    On the 1896 Chickasaw Census Roll for Pickens County, Velma Township, Indian Territory, Thomas B Payne is shown as a 34 year old male, with his tribal enrollment taking place in 1897 in Pickens County (No. 77). He was shown as the son of Thomas H. Payne and Martha J. Payne, both noncitizens. His son, Thomas H. Payne, is shown as being 5 years old, 1/32 Chickasaw by blood, with a tribal enrollment also in Pickens County (No. 20), and shown as the son of Thomas B. Payne and Mollie Payne (deceased), a resident of Pickens County.

    An unnamed baby, a child of Thomas Payne, is buried (undated) in Section 9, Block 15, Plot 7, Marlow Cemetery, Oklahoma. It is not known if it was a boy or girl. Could this have been a child of Thomas and Molly? The three of them are buried side by side.

    Mr. & Mrs. Rufe Deck came down from Chickasha to attend the funeral of Tom Payne who died this morning at 6.

    Died this morning at the residence of John O'Neill, Tom Payne, after a long and lingering illness like consumption. He owned a fine farm near Arthur where he lived with his family. He leaves a wife & 4 children, the oldest, a son who is attending school in Decatur, TX. He will be buried in the Marlow Cemetery. He was a bro. to Mrs. John O'Neill, Walter & Wm. Payne of Marlow.     Charles Strong reports that Thomas Bunker Payne died without a will. He owned some 300 acres of land that he had been alloted as being a Chickasaw by Marriage, so it took some time to settle his estate due to his children being minors. He cites Stephens County OK Probate Case #290. Walter W. Payne was guardian and executor of his estate.

    Monument Unveiled
    On Sunday afternoon in the biting wind the Duncan camp W. O. W. unveiled the beautiful monument erected by that order at the grave of Thos. Payne. The attendance was large the weather considered. The beautiful ceremony was carried out by the Duncan camp and a short talk made by G. W. Siever, C. C. of Marlow camp. The monument is imposing being the largest one in the cemetery.

    He ran cattle on land leased from Indian Territory (Oklahoma) Indians. It cost him ten cents an acre. He made a great deal of money out of this. He and his brother-in-law started a bank in Duncan. The checks were yellow and easily spotted in a pile.

    In a biography of his brother-in-law, John O'Neill, he was referenced as "Walter, a farmer and rancher at Duncan."

    W. W. Payne is shipping out several cars of cattle today. They are consigned to Oklahoma City and Wichita markets.

    1919-Walter W. Payne, resident of Duncan, files an Affidavit of Heirship concerning his older brother Samuel's affairs. Samuel had died intestate nine years previously.

    1920-A Lodger in the home of Sarah Garrison of Alabama, in the King Township of Duncan. His occupation was listed as Farmer, Home Farm.

    1929-Walter W. Payne is buried in Section 10, Block 10, Plot 6, Marlow Cemetery, Oklahoma."

    Walter Payne Answers Call Brief Illness Fatal to Pioneer Rancher of Stephens County. Funeral Services This Thursday.

    Funeral services were held this Thursday afternoon for Walter W. Payne, pioneer ranchman of this section, who passed away early Wednesday morning. Services were at the First Methodist Church at 2 o'clock, with Rev. J. J. Ward officiating, assisted by Rev. A. P. Johnson.

    Burial was in the Marlow Cemetery. Arrangements were in charge of Beeson Grantham.

    Mr. Payne had suffered an attack of acute indigestion on Monday. He appeared to recover from this attack but was not feeling in the best of health, and decided to go to Sulphur for treatment. He left Tuesday, accompanied by his daughter, Mrs Jack Benton, and Mr. Benton. He was feeling much better Tuesday evening, and Mr. Benton returned to Duncan. Mrs. Benton remained with her father.

    Early Wednesday morning Mr. Payne suffered a second and more serious attack, resulting in his death at 2:30 o'clock. The deceased was born in Missouri, coming to what is now Stephens County when he was 20 years of age. He has since lived most of the time at his ranch 10 miles east and 3 miles north of Duncan.

    He was also active in the affairs of this city. He was associated with the late J. D. Wade and J. M. Armstrong in the Duncan National Bank and also served on the city council at an early day. Mr. Payne had been engaged in the raising of beef cattle at his ranch during the past few years. He recently purchased two Hereford bulls that ranked high at the fat stock show at Ft. Worth, said to be two of the finest beef animals ever brought to Stephens County.

    Six children, four daughters and two sons, survive. The daughters are Mrs. Ethel Benton of this city; Mrs Hoyt Hardin, 609 Maple Avenue; Mrs Vera Roberts of Oklahoma City; and Mrs. Louise Birnie of Shawnee. The sons are Carl and Dukie Payne, who lived with him on the ranch. There is one brother, Newton Payne, of Chandler, Arizona, and one sister, Mrs. A. Scott, of Ft. Worth. Seven grandchildren also survive. Mr. Payne was a member of the Masonic and Woodmen lodges, and of the Methodist Church.

    His wife Gertrude and daughter Emma died prior to the 1910 census, and Walter can be found with his sons Carl and John E "Dukey" sharing the home of his recently widowed sister-in-law, Lillie James Payne. His youngest daughter, four year old Louisia, was living with her maternal grandparents, William and Mollie Gentry, listed as "Layease, age 4." His older daughters, Mary Ethel (age 11), Vera (age 9), and Virginia (age 7), were enrolled at the St. Joseph Catholic Boarding School in Chickasha, Grady County.

    The item below was discovered by Mary Pat Strong and her dad, Charles R. Strong during research in LaGrange Public Library. They were asked by a historian there if our Samuel Marshall was related to Thomas R. Marshall. It appears he was a great-nephew.

    Boyhood home of US Vice President: Thomas R. Marshall (1854-1925) lived in LaGrange 1858-60. Because his father was an abolishionist[sic] and he and he and his neighbors did not agree in this violent period of history, the family fearing bodily harm crossed the Mississippi at night in 1860. Later Mr. Marshall became a reform Governor of the State of Indiana, and a popular Vice-President of the United States under Woodrow Wilson, serving two terms. He was on the threshold of the Presidency when Woodrow Wilson suffered a debilitating stroke. He was an apt phrase maker and his quote "What this country needs is a really good 5 cent cigar" was widely quoted. Mr. Marshall returned to LaGrange as Governor of Indiana and prospective Vice-President of the United States on September 17, 1912. He was received by Missouri and Illinois state officials and a crowd of 3,500 people who gave him a tumultuous welcome.

    He served two terms as Vice President under President Woodrow Wilson. The older lady in the picture was Mrs. Carrick, a neighbor, who remembered Thomas Marshall.

    Thomas Riley Marshall, (1854-1925), the 28th VICE PRESIDENT OF THE UNITED STATES. He was born in North Manchester, Ind., on March 14, 1854. He graduated from Wabash College in 1873, studied law, and was admitted to the Indiana bar in 1875, practicing his profession at Columbia City. In 1908 he was elected governor of Indiana; his administration was progressive. Several laws Marshall sponsored, including an employers' liability law and a child labor law, were enacted, but he failed to have a new state constitution adopted.

    At the Democratic National Convention in Baltimore in 1912, Marshall was the favorite-son candidate of Indiana for the presidency. When Woodrow WILSON was nominated for that office, Marshall was chosen for the vice presidency. Reelected in 1916, he served with Wilson until 1921. As presiding officer of the SENATE, he enjoyed much popularity, becoming known for his humorous remarks. In 1917, during a Senate debate on the country's needs, he said, "What this country needs is a good five-cent cigar."

    While Wilson attended the peace conference after World War I, Marshall presided over cabinet meetings, the first vice president to do so. During Wilson's serious illness, beginning in late 1919, Marshall considered the possibility of declaring himself acting president. But he decided not to do so, partly because he feared that his action would divide the country. He died in Washington, D.C., on June 1, 1925.
