    In THE PAYNES OF VIRGINIA, the author notes that the badly defaced tombstone of Elizabeth was discovered in 1907 beneath the tomb of her second husband, Captain McCarty, and read "(Here liet)h the body of Elizabeth (daught)er of Humphrey Pope, Gentleman, by (Elizabeth) his wife, first the wife of (William Pay)ne, Gentleman, to whom sh(e bore two so)ns and two daughters, and last(ly of) Daniel McCarty, Esq., to (whom she) was married 19th October (1699 and b)ore four sons and four daugh(ters). She was born ___ of June 1667."

    After Elizabeth POPE PAYNE lost William PAYNE she married [on 19 Oct 1699] Capt. Daniel MCCARTY who died 4 May 1724. He was the son of Dennis MCCARTHY and Elizabeth BILLINGTON of Richmond Co., VA then he married 2nd Mrs. Ann FITZHUGH widow of William FITZHUGH and she was the daughter of Richard LEE and Lettice CORBIN.

    Notes:

    His will dated 20 June 1769 (16 Sept 1776) named his sons in the order William, Edward, Sanford, and John, and mentions his wife and daughters, but not by name. His wife was to live on the plantation on which he lived if she so chose, otherwise, his son Edward was to possess it. Edward was named as sole executor, and was to have the care and education of testator's son John. (Payne, The PAYNES OF VIRGINIA).

    Her father's will dated 1697/8 referred to her as under sixteen. She m. John Sturman of Cople Parish, Westmoreland County. The will of her stepfather, Daniel McCarty, dated 1724, bequethed her a Bible and expressed the wish that she make good use of it. The present non-original record of this will names her as Elizabeth Sherman, which name, according to contemporaneous records of Westmoreland County, clearly should be Sturman.

    Her father's will dated 1697/8 referred to her as under sixteen; on reaching that age she was to receive 20,000 #. The will of her step-father Daniel McCarty dated 1724 referred to her as Mary Burns, and gave her a Bible with the hope that she would make good use of it. The records of Westmoreland County fail to throw light on her history, or to furnish any suggestion as to her husband's first name. (Payne, p. 231).

    "He was five feet, five inches tall, quite slender, not a military man at all, though Washington Irving said that he did more than any other man to keep up the financial end of the army in Virginia."

    There was to be a meeting, in the Fall of 1755, in Alexandria, Fairfax County to chose a delegate to represent the county in the House of Burgesses at Williamsburg. As it rained on the particular day appointed Col. George Washington (23), who was just a few month's "flush with the laurels of Braddock's Field," assumed that the meeting would be postponed. Washington's regiment at the time was still at Fort Cumberland. Next day he showed up for the meeting and was outraged that it had in fact gone ahead and that the assembled gentlemen and planters had made a selection without him being present. There was a heated argument between him, representing the losing candidate, and William Payne, representing the successful. In impetous anger the Colonel referred to William Payne as something other than a southern gentleman. The small and slender William (31) instantly took his hickory walking stick and lashed out in the public square. He knocked George Washington down. Washington's officers immediately whipped out their cold irons. Washington stopped any further developments. This settled the matter for the day. Next day Mr Payne received a polite message that Washington wanted to meet him at a certain tavern nearby. He went with the feeling that there was to be a challenge to a duel. Greeting him in a friendly way Washington ushered him to a table at the back where there was a bottle of wine. He apologised for what he had said, saying he had no right to speak like that. William was deeply moved. Where upon the two men drank toasts to each others health and became friends. Some time later William visited Washington's home at Mt. Vernon. Washington introduced his wife, Martha, to the man who, he said, had the courage to attack him even though he, Washington, was a much bigger man."     Notes:

    In 1755, on an expedition against the Shawnee Indians, Ensign Edward Payne marched with an outfit commanded by Capt. Lewis Elzey to Winchester. Members of the party had enlisted to serve 30 days. No relief arriving at the expiration of that period, some of the officers and enlisted men chose to leave. Among the group that left was Ensign Payne. Therefore a subsequent claim for compensation for this service was rejected. He later served as a Church Warden, Justice of Fairfax County, and Sheriff. In 1782 he was recorded in the Virginia Census as head of a family consisting of 8 whites and 26 blacks.

    Col. Edward Payne was a member of the Danville (Ky.) Convention on 23 May 1785. Kentucky was finally separated from Virginia in 1792 after seven such conventions. Edward was a member of the Kentucky Constitutional Convention and Senatorial elector for Fayette County.

    Notes:

    Moved to Kentucky in the mid 1780's. He was arrested by Colonel Levi Todd on 6 September 1786 and threatened to be treated as a deserter until he furnished a substitute for his service. He settled in Scott County at Payne's depot near Georgetown. The Magazine of the Kentucky Historical Society refers to him as General John Payne, and states that he commanded Kentucky troops in the first expedition against the Indians in 1812. He was a State Senator from Scott County from 1830-1832.

    According to his son, Asa, he died after being thrown from his horse.

    Westerfield's book of Kentucky Genealogical and Biographical Sketches states that he was in the Virginia Militia, and present at the surrender of Lord Cornwallis, soon after which he settled in Kentucky; was active in the Indian wars on the frontier; a general in the war of 1812, a State senator, a farmer and large slave holder, and died in 1837.
